It is my understanding from others that Joe Ballard, a former prosecutor, had been forced out for perceived malfeasance (Unethical, lying, etc.), and was then appointed as a Judge by the governor.

    I, Wesley, will start this one off,  I am an Asperger's/High Level Autistic (F84, Level 1).  As part of that, I don't make much eye contact and may make minor expressions wrong sometimes, or not understand yours.  We see the social world different but some of us adapt well enough its not "obvious".  The bullying type, whether man or woman, sometimes thinks they're going to "teach me a lesson" if I do anything "odd".  Ballard is one of those bullies.  Immediately from the start of when he first was on the bench, he was making snide or derogatory personal remarks.  Despite me ignoring it and continuing to be nice, to continue to bully me he ignored the law for 4 years with a smirk, and has now helped take my son away from me, a successful Christian businessman, for no reason.  Now that I've had enough, after 4 years of taking it and still being nice and following law while he did the opposite, I'm fighting back to get this incompetent bully off the bench.  Now he wants to find me in contempt and silence us.  My rights don't change with your feelings Ballard, or who you're buddies with.  The law is the law and applies equally to all. 

    I am attaching the appeal here, as I've seen him intentionally ignore the law for 4 years now, for no valid reason whatsoever.  Now he's trying to find me in contempt for letting people tell their own stories to silence us and for his signs that are about to go up over 3 counties.   I refuse to be bullied anymore or watch this "judge" ignore law.  I remember one time he followed the law in 4 years, and that took three motions and a new ruling from the Supreme Court before he would allow someone their constitutional right to a jury trial.  And then he made the jury instructions incorrect and vague, omitting all the important parts of law, to get the illegal result he wanted for his buddies so they could steal my constitutional property rights.

     Beyond that, he would try to change deeds to say something they didn't to help his buddies and take my land and rights, ignore or change contracts and deeds (They are not allowed to modify a written instrument), and once even approved a contract and then immediately changed half the terms to help his other buddy in another case.  Courts don't have that power!  It's clearly written in law that they can't.  He doesn't care though.  He's just a thug on a bench.  Now, he's about to try to steal another 17 acre piece I own by deed and contract after messing with my family.  It just never ends.  If I wasn't limited to 25 pages in this appeal, it would have been 100 pages long in just this one case.  And in case you're wondering, the other side didn't appeal anything, of course, since he made sure they got anything they wanted, even though they had no legitimate claim and it was a totally meritless lawsuit.  It would never have been filed in any legitimate court.  When motions were made that Ballard "had" to sign and approve by law, nope, didn't care, over and over.  I've never seen anyone so brazen.  

     My jaw dropped from the start, when these people blocked 3 of my deeded roadways to 2 farms, admitting I owned them by deed, and he let them keep blocking for 3 years, until he could confuse the jury enough.  This is the equivalent of someone stealing a car, and arguing "they like it better", and he lets the car thief keep the car during 3 years of litigation and not the titled owner.  There is no equal protection under the law here.

    I have proof of Ballard lied, to get appointed and take over a past case.  I also have a page set up showing what he said and pictures of it being a lie.  I witnessed Ballard, our commonwealth attorney, who is now circuit court judge, lie on the record stating he didn’t know the former horse cave police chief, Sean Henry, even though he had prosecuted Henry’s cases for a minimum of 8 years and they were friends on FaceBook.

    Judge Joe Ballard granted a D.V.O. against me, a loving father and successful Christian businessman, who never threatened anyone ever, against a person who had verbally abused me and my child for decades, while the child was being hidden from his family by the disturbed mother.   This was done despite the family testifying how she abused us for decades and there being no threats of any kind, because she "didn't like being questioned on the stand in court".  While she had no witnesses and wouldn't even bring my son to court for people to see whether he was ok.  My family can't believe what they're seeing.  Facts and law don't matter here in Hart County!  (Nor common sense clearly)

     Judge Ballard wanted to assign a "Friend of the Court" related to a custody hearing.  I had an assistant find someone with no involvement with either party whatsoever or the judge, which would be helpful in the situation.  However, Judge Ballard wanted to hire his friend from Nelson County to get the desired biased result and get his friends paid.  The other lawyer wasn't part of their club.  He actually berated this other lawyer he had never even met, who was one of the nicest people I've ever seen.

    Judge Ballard is trying to take a closed case, and call us back to court to try to take my land and give it to his buddies, with no right to a jury trial since the case was closed months ago.  Then you couldn't appeal it since all appeals period has passed.  And he acts like we are supposed to just go along with it because he said so, he's the judge.... What the law says doesn't matter to Ballard.

     Judge Joe Ballard sticks with his buddies in Nelson Co.  The news reported:

     "A Nelson County prosecutor accused of making sexual and racially inappropriate comments tells WAVE News Troubleshooters they were jokes.

Defense attorneys in a complicity to murder trial asked for the Nelson County Commonwealth's Attorney, Terry Geoghegan to be removed from the case during a hearing Wednesday. Judge Joe Ballard denied the motion stating the comments were not directly involving the 2021 murder case against Andrew Toogood.

     Court documents filed by Toogood’s attorneys cite personal text messages sent from Geoghegan to attorneys with the Department of Public Advocacy in April talking about a Hispanic defendant.

     “Seems like we would be safer if he was out of the country,” the text reads.  A following text states, “I’d like to trade him for a whole Hispanic family to come live on my farm. With beautiful college-aged daughters.”

    The sad truth is most people don't even know how wrong they were done, or are too afraid to speak out because it's more than just Ballard, and they'll make up charges or other things against people to protect each other.   Property is being stolen, families torn apart, constitutional rights trampled, etc.  This man is playing God with no interest in what laws or rights are.
